An impartial mediator facilitates the negotiation process by encouraging the parties to describe the problem, discuss the individual solutions they need and finally propose a range of possible solutions.
The purpose of involving a mediator is thus to increase the probability of the parties reaching a negotiated solution.
A mediator will not propose a solution or make a legal assessment of the dispute. The mediator ensures that the parties negotiate constructively so that they find a solution themselves.
Before starting mediation, we discuss the options with the client, and consider the risks of litigation vis-a-vis an out-of-court settlement. This provides our clients with the best possible basis for deciding – in consultation with us – how best to resolve the matter.
