Dispute Resolution
Arbitration
A large number of commercial cases are resolved through arbitration. This is usually due to a wish not to have the conflicts disclosed publicly along with a wish to exercise a greater degree of influence on the process. Arbitration is frequently a cost-effective solution for a business faced with a commercial dispute.
Arbitration in essence means that the parties to a dispute agree to allow the conflict to be decided by one or more persons which the parties themselves (in general) have appointed rather than bringing the case to the courts. This requires that both parties agree to allow the dispute to be settled by arbitration.
Why choose arbitration?
- The option to appoint arbitrators who have particular knowledge of the case area of the dispute
- Arbitration cases are heard confidentially and in general ensure discretion
- The arbitration ruling is final and may not, as a general rule, be appealed, such as we otherwise see in the courts
- Arbitration cases are frequently less costly than traditional litigation
- The parties involved often experience the form of the arbitration proceedings to be less conflict-laden
